In order to qualify for Public Funding the applicant will need to pass the merits and means tests.
Merits Test – This looks at the merits of the claim and the prospects of success. This will depend on the individual circumstances of the claim.
Means Test – This looks at the Applicant’s financial situation.
If you are in receipt of one of the following benefits you automatically qualify financially for Legal Aid, please note that the merits test must still be satisfied;
Income Based Job-Seekers Allowance
Guarantee State Pension Credit
However, the amounts you receive from some other certain benefits are disregarded for the purposes of the financial assessment; these include, but are not limited to;
Disability Living Allowance
Attendance Allowance paid under Section 64 or Schedule 8 paragraphs 4 or 7(2)
Constant Attendance Allowance paid under section 104 as an increase to disability pension
